Co je nezákonný obsah?

Nezákonný obsah je jakýkoli obsah, který porušuje platné právní předpisy ČR, EU nebo podmínky naší platformy. Příklady zahrnují:

  • Nabídky padělaného nebo nelegálního zboží (např. zbraně, omamné látky, léky bez předpisu)
  • Obsah propagující nenávist, diskriminaci, násilí nebo jiné nezákonné aktivity
  • Spam, phishing nebo jakékoli jiné pokusy o podvod
  • Dezinformace, které ohrožují veřejnou bezpečnost nebo zdraví

Jak nahlásit nezákonný obsah?

Pokud narazíte na nezákonný nebo nevhodný obsah na naší platformě, můžete ho nahlásit přes e-mail:

Jazyk komunikace: Čeština nebo angličtina

Ve zprávě prosím uveďte:

  • Odkaz na problematický obsah
  • Popis důvodu nahlášení
  • Vaše kontaktní informace pro případ další komunikace

Co se stane po nahlášení?

Po nahlášení projde obsah následujícím procesem:

  1. Přijetí hlášení: Vaše hlášení bude okamžitě zařazeno do zpracování.
  2. Zpracování: Moderátoři prověří obsah.
    • Pokud obsah porušuje pravidla, bude odstraněn nebo zablokován.
    • Pokud obsah neporušuje pravidla, zůstane zveřejněn.
  4. Informování: Pokud jste podali hlášení e-mailem, informujeme vás o výsledku.

Čas odpovědi na hlášení: Do 48 hodin.

Možnost odvolání proti odstranění obsahu

Pokud byl váš obsah odstraněn a nesouhlasíte s tímto rozhodnutím, můžete se odvolat.

Jak podat odvolání:

Zašlete žádost na dsa@shopex.cz s následujícími informacemi:

  • Odkaz na obsah, který byl odstraněn
  • Důvod, proč si myslíte, že rozhodnutí bylo nesprávné
  • Jakékoli další relevantní informace

Proces přezkumu:

  1. Obsah bude znovu posouzen moderátorským týmem.
  2. Pokud bylo odstranění chybné, obsah bude obnoven.
  3. O výsledku budete informováni e-mailem.

Pokud nesouhlasíte s rozhodnutím platformy, můžete se obrátit na dozorový orgán EU.

Moderátorský tým provádí finální kontrolu.

Ochrana vašich údajů:

Při nahlášení nezákonného obsahu dbáme na ochranu vašich osobních údajů:

  • Vaše informace budou použity pouze pro vyřízení Vašeho hlášení.
  • Nebudou sdíleny s třetími stranami bez vašeho souhlasu, pokud to nevyžaduje zákon.

What is Illegal Content?

Illegal content includes any material that violates applicable laws in the Czech Republic, the EU, or the terms of our platform. Examples include:

  • Offers of counterfeit or illegal goods (e.g., weapons, drugs, prescription medication without authorization)
  • Content promoting hate speech, discrimination, violence, or other unlawful activities
  • Spam, phishing, or any fraudulent attempts to deceive users
  • Misinformation that endangers public safety or health

How to Report Illegal Content?

If you come across illegal or inappropriate content on our platform, you can report it through the e-mail.

  • Your contact details in case we need further information

What Happens After Reporting?

Once a report is submitted, the following steps take place:

  1. Acknowledgment of the report: Your report is immediately entered into the processing system.
  2. Review process: Our moderation team or automated detection systems assess the content.
    • If the content violates our rules, it will be removed or blocked.
    • If the content does not breach any rules, it will remain available.
  4. Notification: If you submitted your report via email, we will inform you of the outcome.

Response Time: Within 48 hours.

Appeal Process for Content Removal

If your content has been removed and you disagree with the decision, you have the right to appeal.

How to Appeal:

Send an email to dsa@shopex.cz including the following details:

  • A link to the content that was removed
  • The reason why you believe the decision was incorrect
  • Any additional relevant information

Review Process:

  1. The content will be reassessed by our moderation team.
  2. If the removal was incorrect, the content will be restored.
  3. You will be notified of the final decision via email.

If you are dissatisfied with the decision, you can escalate the appeal to the EU supervisory authority.

When reporting illegal content, we take privacy protection seriously:

  • Your information will only be used for processing your report.
  • It will not be shared with third parties without your consent unless required by law.
